Agreement, commerce, and site use

These Terms and Conditions govern access to the Geek Out Galaxy website, customer accounts, product listings, orders, payments, rewards, pre-orders, and related commercial services.

Please review these terms and the connected policies before creating an account, submitting an order, joining a rewards program, or using a transactional feature of the website.

Plain-language agreement

By creating an account, placing an order, redeeming rewards, or using another transactional feature, you agree to the terms that apply to that activity.

These terms do not eliminate a consumer right, statutory warranty, privacy right, cancellation right, refund right, or other remedy that cannot lawfully be excluded or waived.

Where mandatory law provides greater protection than these terms, the mandatory legal protection prevails.

How the Geek Out Galaxy policies work together

The Geek Out Galaxy store is governed by four connected policy documents. These Terms and Conditions establish the general agreement governing website access, customer accounts, transactions, payments, programs, and legal responsibilities.

The other policies provide the detailed operational rules for privacy, shipping, returns, cancellations, and refunds.

A product page, campaign page, cart, checkout, rewards offer, or written promotion may contain additional terms applicable to that transaction or feature.

A specific disclosure presented before purchase may supplement these general terms. It cannot remove a right or remedy that applicable law does not permit Geek Out Galaxy to exclude.

Acceptance and scope

These terms apply to the Geek Out Galaxy website, online store, customer accounts, rewards programs, saved products, promotional campaigns, communications, and purchases made directly from Geek Out Galaxy.

By submitting an order or registering for an account, you confirm that:

  • you have reviewed the terms applicable to that activity;
  • the information you submit is accurate to the best of your knowledge;
  • you have the legal authority to use the submitted account and payment method;
  • you are legally capable of entering into the applicable agreement; and
  • you will comply with applicable laws and the connected store policies.

If you do not agree with these terms, do not create an account, submit an order, redeem rewards, or use another transactional feature.

Informational browsing that does not create an account, submit an order, or use a transactional feature remains subject to the website-use, intellectual-property, security, and applicable legal provisions of these terms.

Eligibility, customer accounts, and account security

A person must be legally able to enter into the applicable purchase agreement to independently create an account or place an order.

A minor may use the store only with the involvement, authorization, and supervision of a parent or legal guardian.

You are responsible for:

  • providing accurate account and contact information;
  • maintaining a current email and shipping address;
  • protecting your password and account credentials;
  • restricting unauthorized access to your account;
  • reviewing orders, rewards, addresses, and account activity; and
  • notifying Geek Out Galaxy promptly of suspected unauthorized access or use.

Do not share an account for the purpose of duplicating benefits, bypassing purchase limits, manipulating rewards, or concealing fraudulent activity.

Geek Out Galaxy may require reasonable identity, address, account, or transaction verification before allowing access to sensitive account information or completing a high-risk action.

We may restrict, suspend, or close an account where reasonably necessary to investigate fraud, protect customers, prevent abuse, comply with law, or enforce these terms.

Account restrictions will not eliminate an obligation to complete, refund, return, or otherwise resolve an existing transaction as required by law.

Website access and acceptable use

Geek Out Galaxy grants customers a limited, revocable, non-exclusive, non-transferable right to access and use the website for lawful personal shopping, account, informational, and community purposes.

You must not:

  • use the website for unlawful, fraudulent, or abusive activity;
  • attempt to obtain unauthorized account or system access;
  • interfere with website security, availability, or performance;
  • introduce malicious code, automated attacks, credential stuffing, or harmful requests;
  • scrape, copy, index, or harvest protected content or personal information without authorization;
  • use bots or automation to evade purchase limits, reserve scarce inventory, or manipulate store features;
  • impersonate another person or misrepresent your authority;
  • submit false reviews, fraudulent claims, fabricated evidence, or misleading information;
  • reverse engineer a protected component except where applicable law expressly permits it; or
  • use the website in a manner that unreasonably burdens the service or harms another user.

Geek Out Galaxy may use proportionate technical and account controls to prevent misuse, protect availability, and investigate suspected abuse.

Product information, images, and availability

We aim to provide accurate product titles, descriptions, editions, languages, contents, dimensions, weights, images, prices, inventory status, and estimated release information.

Product images may contain props, accessories, expansions, painted examples, display pieces, or other items not included in the purchase. The written listing and included-components information determine what is being offered.

Colours, finishes, box art, component appearance, and packaging may vary because of screen settings, printing differences, manufacturing changes, regional editions, or publisher updates.

Product categories, tags, CORE ratings, complexity descriptions, age guidance, player counts, playtime estimates, and editorial recommendations are discovery and informational tools. They are not guarantees that every customer will have the same experience.

Inventory displayed as available may be affected by simultaneous purchases, counting errors, damage, supplier changes, fraud review, or another operational issue.

Adding a product to a cart, favourites list, saved profile, or account does not reserve inventory unless Geek Out Galaxy expressly states otherwise.

If an ordered product cannot be supplied, Geek Out Galaxy may cancel the affected product and provide the applicable refund or offer another lawful resolution.

Pricing, currency, taxes, and errors

Product prices are displayed in the currency assigned to the customer’s storefront or destination.

  • Canadian storefront prices are displayed in Canadian dollars.
  • United States and international storefront prices are displayed in United States dollars unless checkout expressly indicates otherwise.

Applicable sales taxes, shipping charges, discounts, credits, and other order adjustments are displayed during the purchase process and summarized before the customer submits the order.

Government-imposed taxes may be added to the displayed product price as required by law.

International duties, import taxes, customs charges, and brokerage may be payable separately by the recipient unless checkout expressly states that those charges are included or prepaid.

Geek Out Galaxy aims to avoid advertising a product at a price that cannot actually be obtained because of a fixed mandatory non-government fee.

A price, discount, tax, exchange rate, inventory status, shipping quote, or product detail may occasionally contain a typographical, technical, integration, currency-conversion, or human error.

If a material error is identified before fulfilment, Geek Out Galaxy may:

  • correct the information;
  • contact the customer for instructions;
  • offer the accurate price or terms for acceptance;
  • remove the affected item with the customer’s agreement; or
  • cancel and refund the affected transaction.

Geek Out Galaxy will not impose an additional charge on a completed order without authorization.

A genuine pricing error does not require Geek Out Galaxy to supply unlimited quantities at an obviously incorrect price where doing so is not required by law.

Orders, confirmation, and contract formation

Submitting an order is an offer to purchase the selected products and services under the information presented during checkout.

After submission, Geek Out Galaxy will provide an electronic order acknowledgement or confirmation containing or linking to relevant transaction information.

An automated acknowledgement confirms that the order was received. It does not necessarily confirm inventory allocation, final acceptance, packing, or dispatch.

Geek Out Galaxy accepts the order when we expressly confirm acceptance, move the order into active processing after verification, or begin fulfilment, whichever occurs first.

Order acceptance may depend on:

  • payment authorization;
  • inventory availability and allocation;
  • accurate pricing, currency, tax, and shipping information;
  • address and destination serviceability;
  • reasonable fraud and security review;
  • purchase limits;
  • product or carrier restrictions; and
  • compliance with these terms and applicable law.

Geek Out Galaxy may accept part of an order and cancel another part where only some products can be lawfully or practically fulfilled. The customer will not remain charged for a cancelled product or associated charge that should not remain payable.

Customers must review their cart, products, quantities, currency, discounts, shipping address, billing information, shipping service, taxes, rewards redemption, and total before submitting an order.

Contact Mission Control promptly if an order confirmation contains an error. Changes are not guaranteed after processing or fulfilment has begun.

Payments and payment security

Payment must be made using a payment method offered and accepted during checkout.

By submitting a payment method, you represent that you are authorized to use it and authorize the applicable payment provider to process the transaction, including any approved refund, reversal, or adjustment.

Geek Out Galaxy does not store full credit-card numbers, card verification codes, or complete payment credentials.

Payment-card information is collected and processed directly by the applicable payment provider. Geek Out Galaxy may receive limited transaction information such as:

  • payment method type;
  • payment or authorization status;
  • transaction identifiers;
  • refund and reversal status;
  • chargeback or dispute information; and
  • fraud-prevention or verification signals.

A payment authorization may be declined, delayed, reversed, or reviewed by the payment provider, card network, financial institution, or fraud-prevention service.

Geek Out Galaxy may pause fulfilment while a reasonable payment, identity, address, or fraud review is completed.

A customer must not initiate a chargeback or payment dispute for the purpose of obtaining duplicate recovery after receiving a refund, replacement, goods, store value, or another complete remedy.

Nothing prevents a customer from using a lawful payment-dispute process where there is a genuine unresolved transaction issue.

Pre-orders, backorders, and estimated availability

Pre-orders

A pre-order is a purchase of a product that is not ready for immediate shipment.

Publisher, manufacturer, distributor, campaign, release, and fulfilment dates are estimates unless expressly guaranteed.

A pre-order may be affected by manufacturing delays, freight, customs, publisher changes, allocations, production revisions, regional release schedules, or cancellation by the supplier.

Paying for a pre-order creates a customer order but does not guarantee that the publisher or supplier will deliver the exact estimated quantity, edition, date, packaging, or component configuration.

Geek Out Galaxy will not substitute a materially different product without the customer’s agreement.

Pre-order lifecycle stages may include:

  • Pre-order Confirmed;
  • Awaiting Release;
  • Preparing Fulfilment;
  • Shipped;
  • Refund Pending; and
  • Pre-order Cancelled.

A pre-order may generally be cancelled before it enters Preparing Fulfilment, subject to a specific lawful campaign disclosure and the Refund Policy.

Unless a specific offer states otherwise, shipping for a pre-order is collected later, before the applicable pre-order shipment is dispatched.

Backorders

A backorder is a product expected to return to stock after the customer submits the order.

Backorder availability and fulfilment dates are estimates. Shipping for backordered products is normally collected during checkout unless the applicable disclosure states otherwise.

If a pre-order or backorder cannot reasonably be supplied, Geek Out Galaxy may offer an alternative, cancel the affected product, or issue the applicable refund.

Shipping, delivery, and local pickup

Shipping destinations, rates, currencies, member benefits, exclusions, fulfilment timing, tracking, carrier delays, customs, duties, address issues, transit damage, and returned parcels are governed by the Shipping Policy.

Free standard shipping is available to logged-in members on qualifying contiguous U.S. and Canadian orders. Thresholds and exclusions apply.

Local pickup is not an always-available checkout option. It is offered only through an eligible campaign, convention, event, or announced pickup window.

Delivery and release estimates are not guarantees unless expressly identified as guaranteed.

The customer is responsible for reviewing the recipient name, shipping address, unit number, postal or ZIP code, country, telephone number, and selected delivery service before submitting the order.

Customer responsibility for an address error does not make the customer responsible for loss, damage, non-delivery, or another problem caused by Geek Out Galaxy or the carrier.

Returns, cancellations, exchanges, and refunds

Voluntary returns, product-condition standards, final-sale exclusions, cancellations, damaged goods, missing products, incorrect products, exchanges, refunds, return shipping, and reward adjustments are governed by the Refund Policy.

An eligible voluntary return must ordinarily be requested within 30 calendar days after delivery or authorized pickup and must satisfy the condition requirements in the Refund Policy.

Opened, punched, assembled, altered, played, used, activated, or incomplete products are not ordinarily eligible for a change-of-mind return.

Those limitations do not eliminate a remedy for a legitimate defect, missing component, material misrepresentation, incorrect product, non-delivery, or other problem that could not reasonably be identified without opening the product.

Refunds are issued to the original payment method whenever reasonably possible. Payment-provider or financial-institution posting time may apply after Geek Out Galaxy initiates a refund.

Review voluntary-return eligibility, cancellations, damaged or incorrect goods, refunds, return shipping, rewards reversals, and statutory remedies.

G-Credits, Galaxy XP, and member benefits

G-Credits and Galaxy XP are account-based promotional and loyalty features administered by Geek Out Galaxy.

Unless a specific promotion states otherwise:

  • 100 G-Credits equals $1.00 of eligible redemption value;
  • eligible purchases may earn G-Credits and Galaxy XP according to the rate displayed for the applicable program;
  • G-Credits may be redeemed against up to 100% of an eligible product subtotal where permitted by the checkout system;
  • taxes, shipping, duties, gift cards, excluded products, or other non-eligible amounts may be excluded from earning or redemption;
  • G-Credits and Galaxy XP have no independent cash value and cannot be withdrawn as cash;
  • rewards are personal to the eligible account and may not be sold, transferred, or pooled without authorization; and
  • rewards may be corrected where an error, duplicate transaction, fraud, cancellation, refund, or reversal occurred.

A refund or cancellation may restore G-Credits redeemed against the refunded amount and reverse or recalculate rewards earned from that transaction.

A partial refund should adjust only the applicable portion of the transaction. A price-only refund does not automatically represent a physical product return.

Geek Out Galaxy may suspend or adjust rewards activity where there is reasonable evidence of manipulation, duplicate earning, account cycling, unauthorized automation, refund abuse, or another violation.

A rewards adjustment will not eliminate a customer’s right to the underlying refund or consumer remedy.

Promotions, coupons, bundles, and store value

A promotion, coupon, bundle, campaign, contest, giveaway, or special offer may have additional eligibility dates, limits, product exclusions, account requirements, and redemption conditions.

Unless the offer expressly states otherwise:

  • promotions cannot be combined;
  • only one coupon may be applied to an eligible purchase;
  • offers have no cash value;
  • discounts apply only to eligible products and quantities;
  • purchase limits may apply;
  • returning part of a bundle or threshold promotion may require a reasonable recalculation of the remaining order; and
  • a promotion may be corrected, suspended, or cancelled where a material error, fraud, abuse, or legal issue occurs.

Geek Out Galaxy will not retroactively remove a completed discount merely because an internal promotion performed better than expected.

If Geek Out Galaxy offers gift cards or other purchased store value, the applicable terms will be disclosed before purchase and will comply with legal restrictions concerning expiry dates, fees, redemption, and refunds.

Promotional rewards that were not purchased may be subject to the disclosed campaign period and conditions.

Reviews, feedback, and customer submissions

Customers may be permitted to submit product reviews, comments, ratings, feedback, photographs, suggestions, support materials, or other content.

You retain ownership of original content you submit. By intentionally submitting content for public display or store evaluation, you grant Geek Out Galaxy a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, moderate, and use that content for the purpose for which it was submitted.

This licence does not authorize Geek Out Galaxy to sell your private support communications as standalone content.

You must not submit content that:

  • is knowingly false, deceptive, fraudulent, or defamatory;
  • infringes copyright, trademark, privacy, or other rights;
  • contains malicious code, spam, or unauthorized advertising;
  • contains another person’s private information without authority;
  • is threatening, hateful, harassing, or unlawfully discriminatory;
  • misrepresents a paid endorsement or material relationship; or
  • is unrelated to the product, service, or support request.

Geek Out Galaxy may moderate, decline, or remove content for a legitimate legal, safety, relevance, authenticity, or policy reason.

We are not required to publish every review, but we will not suppress a legitimate negative review solely because it is unfavourable.

Intellectual property and permitted use

The Geek Out Galaxy website, branding, logos, page design, graphics, original copy, interfaces, databases, custom code, product presentation, editorial content, and other original materials are owned by or licensed to Geek Out Galaxy.

Publisher, manufacturer, designer, artist, game, product, and third-party names, artwork, trademarks, rulebooks, images, and materials remain the property of their respective owners.

Displaying a third-party product does not transfer ownership of its intellectual property to Geek Out Galaxy or the customer.

You may view, print, or save a reasonable amount of website content for personal, non-commercial shopping or reference use.

Without authorization, you may not:

  • republish or commercially exploit protected website content;
  • copy the store design, database, or custom interface;
  • remove copyright, trademark, or attribution notices;
  • use Geek Out Galaxy branding in a way that suggests sponsorship or affiliation;
  • reproduce substantial catalog content for a competing service; or
  • create derivative commercial materials from protected content except where permitted by law.

Nothing in these terms limits fair dealing or another use expressly permitted by applicable law.

Third-party services, platforms, and links

Geek Out Galaxy relies on third-party services for hosting, ecommerce, payments, fraud prevention, communications, analytics, shipping, carriers, customs processing, account functions, rewards, and other infrastructure.

A third-party provider may apply its own terms and privacy practices to the service it directly supplies.

Geek Out Galaxy remains responsible for obligations that cannot lawfully be transferred to a service provider.

Links to publisher pages, rulebooks, carrier tracking, social platforms, payment services, or other websites are provided for convenience and context.

Geek Out Galaxy does not control every third-party website and does not guarantee its availability, security, accuracy, or content.

Customers should review the applicable third-party terms before submitting information or completing an activity on an external website.

Fraud prevention, purchase limits, and order restrictions

Geek Out Galaxy may use reasonable controls to prevent fraud, payment abuse, rewards manipulation, unauthorized resale, inventory hoarding, account compromise, and prohibited activity.

We may place reasonable limits on quantities, customer accounts, households, addresses, payment methods, campaigns, limited products, pre-orders, or promotional benefits.

Geek Out Galaxy may hold, restrict, cancel, or refuse an order where there is reasonable evidence of:

  • unauthorized payment use;
  • false identity, address, or account information;
  • account takeover or security compromise;
  • automated purchasing intended to evade limits;
  • resale activity contrary to a disclosed offer condition;
  • duplicate promotion or rewards abuse;
  • false refund, damage, non-delivery, or chargeback claims;
  • sanctions, export, customs, or legal restrictions;
  • threats to staff, customers, systems, or carriers; or
  • another material violation of these terms.

A fraud or abuse investigation does not permit Geek Out Galaxy to retain money for goods that will not be supplied where retention is not legally justified.

We may retain records reasonably required to prevent repeated fraud, document a dispute, comply with law, or defend a legal claim, subject to the Privacy Policy.

Service availability, disclaimers, and liability

Geek Out Galaxy aims to maintain a secure and functional website but does not guarantee uninterrupted or error-free access at all times.

Website access may be interrupted for maintenance, updates, hosting incidents, security response, carrier failures, third-party outages, network problems, or circumstances outside our reasonable control.

Editorial recommendations, CORE ratings, complexity descriptions, playtime estimates, age guidance, reviews, strategy content, and other opinions are informational and may not match every customer’s experience.

Nothing on the website constitutes legal, financial, medical, or other regulated professional advice.

To the maximum extent permitted by law, Geek Out Galaxy is not responsible for loss caused solely by:

  • unauthorized use of credentials the customer failed to protect;
  • customer-provided inaccurate information;
  • unlawful or prohibited use of the website;
  • an external website or service outside Geek Out Galaxy’s control; or
  • an event outside our reasonable control where we took reasonable steps to reduce the effect.

These limitations do not exclude responsibility for fraud, wilful misconduct, gross negligence, breach of a mandatory consumer obligation, privacy violation, misrepresentation, personal injury caused by legally actionable conduct, or another liability that cannot lawfully be excluded.

For a product transaction, the customer remains entitled to the remedies provided by the connected policies and applicable law.

Governing law and dispute resolution

These terms and transactions with Geek Out Galaxy are governed by the laws of Alberta and the applicable federal laws of Canada, without limiting mandatory consumer protections that apply in another jurisdiction.

Where legally permitted, the courts of Alberta may hear a dispute connected with these terms or a Geek Out Galaxy transaction.

A consumer may also have the right to bring a claim, make a complaint, or seek a remedy in another jurisdiction where mandatory law provides that right.

Before starting formal proceedings, customers and Geek Out Galaxy are encouraged to make a good-faith attempt to resolve the issue through Contact Mission Control.

Informal resolution is encouraged but is not a condition that prevents a customer from:

  • contacting a consumer-protection authority;
  • contacting a privacy regulator;
  • using an authorized payment-dispute process;
  • seeking urgent or protective relief;
  • using a court or tribunal with lawful jurisdiction; or
  • exercising another non-waivable legal right.

These terms do not require mandatory arbitration as a condition of purchasing from Geek Out Galaxy.

Nothing in these terms requires a customer to waive a right to access a court, regulator, tribunal, complaint process, or statutory remedy where that right cannot lawfully be waived.

Changes, suspension, severability, and contact

Changes to these terms

Geek Out Galaxy may update these Terms and Conditions to reflect changes to website features, products, payment systems, rewards, fulfilment practices, service providers, business operations, or legal obligations.

The revised terms will be posted on this page with an updated effective date and version number.

Revised terms apply to future website activity and transactions from their stated effective date.

Terms specifically disclosed and agreed for an earlier accepted order continue to govern that order unless a change is required by law or agreed with the customer.

Changes to these Terms and Conditions do not automatically amend the Privacy Policy, Shipping Policy, or Refund Policy. Each document maintains its own effective date and version.

Suspension or discontinuation

Geek Out Galaxy may modify, suspend, or discontinue a website feature, program, product category, campaign, or free service.

We will administer existing paid orders, customer balances, and legal obligations fairly and in accordance with the applicable transaction terms and law.

Severability

If a provision of these terms is found invalid or unenforceable, it will be interpreted or limited only to the extent necessary, and the remaining provisions will continue to apply where legally possible.

No waiver

A delay or failure by Geek Out Galaxy to enforce a provision does not permanently waive that provision.

This no-waiver clause does not allow Geek Out Galaxy to revive a right that has expired or been waived under applicable law.
